תמ”א 38 הינה תכנית מתאר ארצית לחיזוק מבנים, על פי תכנית זו יש לחזק מבנים שאינם עומדים בתקן הישראלי (תקן 413) שנכנס לתוקף ב1.1.1980, קרי – מבנים שנבנו לפני ה1.1.1980 אינם עומדים בתקן ונדרש לחזקם.
מה ההבדל בין תמ"א 38/1 לתמ"א 38/2?
בתמ”א 38/1 הבניין הקיים נשאר במקומו ומבוצע בו הליך עיבוי וחיזוק משמעותי, במסגרתו מחוזקים יסודות הבניין (ע”י עיבוי וחיזוק וכן ע”י הוספת ממ”דים), בנוסף לכך מוחלפות התשתיות בבניין וכן נבנים שטחי ציבור חדשים, בהליך זה הדיירים נשארים לגור בבניין במהלך תקופת הבנייה. לעומת זאת, בתמ”א 38/2 הדיירים מועברים על חשבון היזם למגורים חלופיים לאורך כל תקופת הבנייה, והבניין הישן נהרס ובמקומו בונים בניין חדש ובתום תקופת הבנייה בעלי הדירות המקוריים זוכים לדירות חדשות במקום הדירות הישנות שהיו בבעלותם.

בתמ”א 38/1 לרוב הדיירים נשארים לגור בדירתם המקורית, אם כי יש יוצאים מן הכלל (כגון: בעלי מוגבלויות כאלו ואחרות) אשר לא מתאפשר להם לגור בבניין במהלך תקופת הבנייה ולכן היזם מעביר אותם על חשבונו למגורים חלופיים בתקופת הבנייה. לעומת זאת, בתמ”א 38/2 כלל בעלי הדירות מועברים על חשבון היזם למגורים חלופיים למשך תקופת הבנייה.
שמעתי שהתמ"א נגמרת. זה נכון?
המועצה הארצית לתכנון קבעה כי תמ”א 38 במתכונתה הנוכחית תסתיים באוקטובר 2022, ועל כן רצוי להקדים את תהליך התכנון עד למועד זה על מנת לזכות במירב ההטבות שהתכנית מעניקה לבעלי הדירות. אין זה אומר שלאחר מועד זה לא תהיה עוד תמ”א, אך ניתן להעריך כי ההטבות המוענקות לבעלי הדירות והיזמים יפחתו משמעותית.
